Amendments in the Constitution (Scheduled Tribes) Order, 1950 Approved by Union Cabinet

Two Bills in the Parliament for certain amendments in the Constitution (Scheduled Tribes) Order, 1950 has been approved by the Union Cabinet which are aims to modify the list of Scheduled Tribes in deference of five States are:

  1. Assam
  2. Chhattisgarh
  3. Tamil Nadu
  4. Jharkhand
  5. Tripura
  • The objective is to identify new communities in the Union Territory of Puducherry.

Communities to the list of Scheduled Castes:

  • Assam: Boro, Boro Kachari, Bodo, Bodo Kachari and Karbi (Mikir) communities are included in the list.
  • Chhattisgarh: Bhuinya, Bhuiyan, Bhuyan, Dhanuhar⟋Dhanuwar, Kisan, Saunra, Saonra and Dhangad communities are includede in the list.
  • Jharkhand: Bhogta, Deshwari, Ganjhu, Dautalbandi (Dwalbandi) , Patbandi, Raut, Maajhia, Khairi (Kheri) and Puran communities are included in the list.
  • Tamil Nadu: Malayali Gounder, Narikoravan and Kurivikkaran communities added in the list.
  • Tripura: Darlong community is included in the list.
  • Puducherry: Identification (First Order) of Irular (including Villi and Vettaikaran) .
  • This all community՚s members will be able to derive benefits which are provided to Scheduled Tribes under the existing schemes after these Bills become Acts.

Constitutional provisions:

  • The Constitution provides assured privileges⟋concessions to the members of Scheduled Tribes which are notified under the provisions of Article 342.

Article 342:

  • It allows President after consultation with the State Government to issue an order for the first list of Scheduled Tribes.
  • Any succeeding enclosure or exclusion from the list of Scheduled Tribes can be realized through an Act of Parliament as envisaged under clause (2) of Article 342.
