Election of VP

  • The Vice-President is elected by an electoral college consisting of all the members of the Lok Sabha and Rajya Sab. Ha_ (including nominated ones) , through proportional representation by means of a single transferable vote. Removal
  • The Vice-President could be removed from his office by a resolution of the Rajya Sabha passed by an effective majority and agreed to by the Lok Sabha. Effective majority
  • This is more than fifty per cent of the effective strength of the House (vacancies are not taken into account) . In other words, the effective strength of the House is total strength of the House minus the number of vacancies. In case of Rajya Sabha (total strength 245) , if there are 15 vacancies, 230 shall be the effective strength and more than 50% of this i.e. … 230 or more is called effective majority. Removal of the Vice-President of India requires ‘effective majority’ for passage of such a resolution to this effect [Art. 67 (b) ] .
  • President shall be decided by the Supreme Court whose decision will be final.
  • If the election of the Vice-President is declared null and void by the Court, the acts done by them in performance of their duties shall not be invalidated by the reason of that declaration.
  • The Parliament has the power to regulate matters relating to the election of the Vice-President.
  • The election of a person as the Vice-President shall not be questioned on the ground of the existence of any vacancy among the members of the electoral college.
  • The salary of the Chairman of the Rajya Sabha is ₹ 40,000/-per month according to the Act of Parliament, 1998.
