It is a Constitutional body established under Article 338 and not a statutory body as it is not established by an Act of Parliament like National Commission for women, National Commission for Minorities, etc.
Evolution of the Commission
- Earlier Article 338 provides for appointment of Special Officer for Schedule Castes and Schedule Tribes Rights.
- In 1978 a Non-Statutory Commission for SC՚s and STs was established.
- In 1987 it was Renamed and modified as National Commission for SC՚s and STs
- In 1990 by 65th constitutional amendment Act a multi-member commission was established
- In 2003 the Commission Bifurcated into two
- 1. National Commission for Schedule Castes (Article 338)
- 2. National Commission for Schedule Tribes (Article 338-A)
- Chairman and member of the Commission are appointed by the President
Functions of the Commission
- To investigate and monitors safeguards for Schedule Castes
- To inquire into complaints by Schedule Castes
- To Plan the Social and Economic Development of Schedule Castes.
- To present report on the working of safeguards for Schedule Castes to the President
- To make recommendations for protection and welfare of the Schedule castes
- To perform functions for development and advancement of Schedule Castes
Report of the Commission
- Annual Report is submitted to the President by the Commission
- In Parliament president places the report along with a memorandum.
- The President also forward the report to the State Legislature with a Memorandum when necessary
- The Commission regulates its own procedure.
- It has a power of civil court.
- It can Summon and examine any person from India
- Requires any documents and can receive evidence on affidavits
- Investigate public records and examine witnesses.
