Union Cabinet has approved appointment of Adjudicating Authority & establishment of Appellate Tribunal under Prohibition of Benami Property Transactions Act (PBPT), 1988. Benches of Adjudicating Authority may sit in Kolkata, Mumbai & Chennai & necessary notification in this regard shall be issued after making consultation w/Chairperson of proposed Adjudicating Authority.

Salient Features of Appointment of Adjudicating Authority

  • Appointment of Adjudicating Authority, along w/3 additional Benches & to establish Appellate Tribunal under PBPT Act

  • Provide officers & employees to Adjudicating Authority, Benches of Adjudicating Authority & Appellate Tribunal by diverting existing posts at same level/rank from Income Tax Dept. /Central Board of Direct Taxes (CBDT)

  • Adjudicating Authority & Appellate Tribunal shall sit in National Capital Territory of Delhi (NCTD). Benches of Adjudicating Authority may sit in Kolkata, Mumbai & Chennai & necessary notification in this regard shall be issued after making consultation w/Chairperson of proposed Adjudicating Authority.

  • Approval will result in effective & better administration of cases referred to Adjudicating Authority & speedy disposal of appeals filed against order of Adjudicating Authority before Appellate Tribunal.

  • Approval would provide first stage review of administrative action under PBPT Act. Establishment of proposed Appellate Tribunal would provide appellate mechanism for order passed by Adjudicating Authority under PBPT Act.
