Who Prepared The NALSA’s Compensation Scheme?

  • Scheme was prepared by National Legal Services Authority (NALSA) in consultation w/Union Govt.

  • Bench of Justice Madan B Lokur & Justice Deepak Gupta ordered that scheme should be implemented in all states & UTs.

Highlights of Compensation under NALSA’s Compensation Scheme

  • Scheme defines compensation slabs for victims of sexual assault, acid attacks & even for loss of fetus.

  • It empowers legal services authority to take suo motu cognisance of cases of sexual assault & acid attacks to grant interim relief after preliminary verification.

  • Under scheme, compensation fund will be set up that will be managed by State Legal Services Authority (SLSA).

  • Compensation fund will set up portal for victims to apply online for compensation.

Status of Nirbhaya Fund

  • Bench was told that though Centre had cleared Rs. 3500 cr. fund under Nirbhaya Scheme, but only 9 states have received funds so far.

  • There are various cases in which victims are not paid w/compensation, which is pending since 2013.

  • To this, apex court replied that it would deal w/issue of Nirbhaya Fund in July 2018.

  • Union Govt. created Nirbhaya Fund in 2013 to support state govt. & NGOs working for women’s safety.

  • Fund was created following Nirbhaya gang-rape case in Delhi in December 2012.

Background on the NALSA’s Compensation Scheme

  • Report was submitted by NALSA Director Surinder S Rathi in apex court, directing Union Ministry of Women & Child Development & Principal Secretaries of all states to undertake steps to ensure implementation of scheme as soon as possible.
  • NALSA had informed apex court that only 5 to 10 % of sexual assault victims across country were able to get compensation in various states till now.
