NITI Aayog has proposed to replace Medical Council of India with the National Medical Commission (NMC) to create a world Class medical education system ensuring supply of high quality undergraduate and postgraduate medical specialists.

The bill encourages medical specialists:

  • to include the latest medical research in their work
  • provide objective periodic assessment of medical institutions
  • maintain medical register for India
  • carry out high ethical standards
  • be flexible to enable transforming nation

National Medical Commission Act, 2016 will extend to the whole of India.

Medical Advisory Council

Under this Act, Medical Advisory Council constituted by the central government will be act as primary platform for states to give their opinion.

National Medical Commission

National Medical Commission constituted by central government will be a perpetual succession and a common seal corporate body to have power to acquire, hold and dispose movable and immovable property.

Power and Functions of National Medical Commission (NMC)

  1. Measure the changing requirements of the health care scenario, allocate human resources for health, health care infrastructure and will find out solution to meeting these requirements.
  2. Make necessary policies for the governance of Medical Education.
  3. Make regulations for smooth working of the Commission and the Boards under the provisions of this Act and based on the Rules of the Boards.
  4. Provide policy coordination among the Boards respecting their autonomy.
  5. Govern State Councils so they effectively enforce the provisions of the Act and take appropriate action if they fail.
  6. Implement Appellate Authority based on decisions of the UGMEB, PGMEB and MARB (discussed later) .
  7. Suggest norms for fees appropriation in the Private Medical Educational Institutions.
  8. Exercise powers and duties according to the Act.

Under Graduate Medical Education Board

Under Graduate Medical Education Board (UGMEB) established by Central Government will work according to the policies and rules developed by the NMC.

Power and Functions of UGMEB

  1. Propose standards and manage all aspects of undergraduate medical education.
  2. Develop vocational dynamic curriculum for undergraduate to have appropriate knowledge, skills, attitude, values, and ethics for providing health care, as per the societal needs.
  3. Provide guiding principles for medical institutions for under graduate courses.
  4. Decide and propose minimum requirements and standards for courses and examinations.
  5. Decide and suggest standards and norms for infrastructure, faculty, and quality of education.
  6. Standards and norms to be the basis for the assessment of the institutions by MARB.
  7. Provide development/training for the undergraduate courses faculty teaching.
  8. Provide facility to implement undergraduate education related research, international student and faculty exchange programs.
  9. Recommend and seek directions from the Government.

Medical Assessment and Rating Board

The Medical Assessment and Rating Board (MARB) established by Central Government will work according to the policies and rules developed by the NMC.

Powers and Function of MARB

  1. Regulate the process of assessment and rating of Medical Educational Institutions based on UGMEB or PGMEB standards.
  2. Appoint credible third party agencies or personnel for inspections of the Medical Educational Institutions. Institutions compulsory must allow MARB authorized inspecting team.
  3. Rate all Medical Educational Institutions, at specific period and every year thereafter and provide these in public domain at regular intervals-can be subcontracted to independent ratings agencies.
  4. Monitor and enforce penalties if institutes fail to maintain the minimum essential standards.
  5. Recommend and seek directions from the Government.

Board for Medical Registration

Board for Medical Registration (BMR) established by Central Government will work according to the policies and rules developed by the NMC.

Powers and Function of BMR

  1. Maintain a live electronic National Register (NR) with all details of licensed medical practitioners including name, address, date of birth, Aadhaar ID and all qualifications certificates of UGMEB and PGMEB.
  2. Propose the standards of professional conduct and develop a Code of Ethics for medical practitioners.
