What is Emigration? : - As per the Emigration Act, “emigration” means the leaving of India of any Indian citizen with the intent of taking up employment in a foreign country. What is ECR? : - As per the Emigration Act, 1983, certain categories of Indian passport holders require to obtain “Emigration Clearance” from the office of Protector of Emigrants (POE) for going to certain countries. It is called emigration check required. ECR is for the safety of Indian citizens due to the legal conditions of other countries based on various conditions.

Indian passports divided into two categories:

  • Passports with endorsement - Emigration Check Required (ECR).
  • Passports with endorsement - Emigration Check Not Required (ECNR).
  • For passports issued before January 2007, no notation means ECR.
  • For passports issued in or after January 2007, no notation means ECNR. If Emigration Check is Required, there will be an endorsement in the passport regarding ECR.

ECR Countries

If a passport is subject to ECR, emigration clearance is required to enter any of the following countries for employment:

  • Afghanistan
  • Bahrain
  • Brunei
  • Kuwait
  • Indonesia
  • Iraq (emigration banned)
  • Jordan
  • Lebanon
  • Libya
  • Malaysia
  • Oman
  • Qatar
  • Sudan
  • Syria
  • The Kingdom of Saudi Arabia (KSA)
  • Thailand
  • United Arab Emirates (UAE)
  • Yemen

Travel to any country other than those mentioned above, doesn’t require emigration clearance, irrespective of whether the passport is ECNR or not.

There is mandatory Insurance and medical cover under Pravasi Bhartiya Bima Yojana (PBBY) for all Emigration Check Required (ECR) passport holding Indian workers emigrating with Emigration Clearance to 18 notified ECR countries for employment.

  • Insured of 10.00 lakhs in the event of accidental death or permanent disability leading to loss of employment
  • Medical insurance cover
  • Repatriation cover for medically unfit or premature termination of employment
  • Cover for Family Hospitalization in India
  • Maternity benefit to women emigrants
  • Return economy class air fare to the nearest international airport attendant in case of emigrant’s accidental death or permanent disability.
  • Legal expenses on litigation related to emigrant’s overseas employment
