Right to Information Act the Purpose of Law-

  • Ensure reach of ordinary people to the public authorities under control or information available under it.

  • Provide information related to them or related topics.

Central Information Commission

Central Information Commission has been brought in for implementation of Right to Information. There is a Chief Information Commissioner and Information Commissioner (not more than ten) in the Commission. It is a provision that appointment of Chief Information Commissioner and Information Commissioner will be done by the President on the recommendation of a committee. The committee will include the following members:

  • Prime Minister, who will be the Chairman of the Committee

  • Leader of Opposition in the Lok Sabha

  • A Minister of the Union Ministry nominated by the Prime Minister

Chief Information Commissioner and Information Commissioner, Member of Parliament or a State or Union Territory Legislature shall not be a member or no other person will hold office of profit or will not be related to any political party or any business or institute will do it.

The Central Information Commission will be headquartered in Delhi and the commission will be able to establish its office in other places of India with prior approval of the central government.

Terms and Conditions of Service

The Chief Information Commissioner and Information Commissioner shall hold the post of five years or till the age of sixty-five (whichever is earlier). And will not be eligible for reappointment. The Commissioner shall be eligible for appointment as Chief Information Commissioner But, as the Chief Information Commissioner of the Commission, the Commission shall not be more than five years in total. The Chief Information Commissioner and other information commissioners take the pledge before the President or any person authorized by him. The Chief Information Commissioner and Information Commissioner may at any time leave the post by writing with his signature related to the President. The Chief Information Commissioner's salary allowances and terms of service will be the same as those of Chief Electoral Commissioner. The non-profit changes will not be made after the appointment of the Chief Information Commissioner and the salary allowances of the Information Commissioner and other conditions of service.

Removal of the Chief Information Commissioner or the Information Commissioner-

Based on the basis of proven misconduct or inability on the basis of the highest court report by the President Chief Information Commissioner and Information Commissioner can be removed from the post. Apart from this, in the following circumstances, they can be removed from the post by the President-

  • On bankruptcy

  • On conviction for guilt

  • During the term and in the case of salaried employment

  • Being mentally and physically disabled

  • On any contract or agreement made by or on behalf of the Government of India
