  • By 89th Constitutional Amendment Act 2003 a separate National Commission for STs was Created and added Article 338-A.
  • In 2004 National Commission for Schedule Tribes.
  • The President appoints the Chairman and members and their tenure.

Functions of the Commission

  • It investigate and monitors safeguards for Schedule Tribes.
  • Inquire into complaints by Schedule Tribes.
  • Socio Economic development Of STs.
  • Reports to the President on the performance of the safeguards.
  • To recommend measures for protection and welfare of STs.
  • Discharge functions for Development and Advancement of Schedule Tribes.

  • Confer ownership rights to STs.
  • To safeguards rights of tribal communities.
  • Measures for development of livelihood strategies
  • Improve efficiency to provide relief
  • Prevent Alienation of Tribal people
  • Maximise cooperation and involvement of tribal people
  • Implementation of Panchayats Act , 1996
  • Eliminate the practice of shifting culture

Report of the Commission

  • Annual Report is submitted to the President by the Commission
  • In Parliament president places the report along with a memorandum.
  • The President also forward the report to the State Legislature with a Memorandum when necessary
  • The Commission regulates its own procedure.
  • It has a power of civil court.
  • It can Summon and examine any person from India
  • Requires any documents and can receive evidence on affidavits
  • Investigate public records and examine witnesses.
